Will I be informed if I fail a drug test? ›

In general, the results of a failed pre-employment drug screen or failed drug screen for a current employee are confidential between the company that requested the test and the individual who took it.

Common potential consequences of failing a drug test at work are termination, suspension, recommended substance use disorder treatment, or other disciplinary actions. Although positive test results often accurately indicate a history of drug use, a false positive may also occur.

Positive drug test results that are explained by a legitimate medical explanation, such as a valid prescription, will not be reported to a federal agency. See (Medical Review Officer Guidance Manual), Chapter 4.5.

How do you know if you passed a pre-employment drug test? If none of the substances being tested for were found in your specimen, your drug test results will be negative. If a drug test result is positive, it means that one or more drugs were found in amounts that suggest drug use or misuse. Positive tests require follow-up testing because they may be wrong (false positives). The follow-up test is usually a test that provides more accurate results.

The presence of CBD itself won't show up on a drug test. However, the use of certain CBD products could, in theory, result in a positive test if there are low levels of THC present. THC sometimes finds its way into CBD products due to contamination in the manufacturing process.

At-home 10-panel drug tests are fairly sensitive to the presence of drugs but certain foods, beverages, supplements, and medications can interfere with results, according to the Food and Drug Administration (FDA).

If the MRO makes a determination that a medical condition precludes you from providing a sufficient amount of urine, the test may be cancelled, and it would not be considered a refusal.

Current case law indicates that in the context of drug testing, an employer or independent testing firm may be liable for negligence when tests are improperly administered, when test results are inaccurately maintained, and when an employee who has tested positive for drugs injures a third person.
